Value Sensitive Design (VSD) is a design methodology developed by Batya Friedman and Peter Kahn (2003) that brings in moral deliberations in an early stage of a design process. It assumes that neither technology itself is value neutral, nor shifts the value-ladennes to the sole usage of technology. This paper adds to emerging literature onVSD for autonomous weapons systems development and discusses extant literature on values in autonomous systems development in general and in autonomous weapons development in particular. I identify (...) opportunities, such as public debates, and threats, such as the classified nature of the design process, for VSD in autonomous weapons development. This paper contributes to academic debates about the non-neutrality of technology by pointing out that values have been and can be explicitly designed into autonomous systems. It is informative for policy makers and designers who are tasked with developing actual autonomous weapons or policies around such systems, as they learn about an established design methodology that is sensitive to societal concerns and industry needs and that can be applied to autonomous weapons systems. For example, in the branch of post-phenomenology, authors such as Don Ihde and Peter-Paul Verbeek have described the mediating aspects of technology in terms of morality of technology (more prominent in Verbeek) as well as in the sense that technology changes our perception of ourselves and the world (more prominent in Ihde). In this article, different existing types of mediation are presented, critiqued, and enriched. The four types are illustrated (...) by referring to military high-tech environments with a focus on visual data and imaging technologies. These technologies can mediate actions (1) by inviting certain behavior, (2) through amplification and reduction, (3) through built-in norms, and (4) through interpretation. The four types of mediation mainly focus on the technology or technological artifact itself. What these approaches fail to grasp, however, is the specific user practices in which most technologies function. In this article, it is argued that to understand the mediating aspects of technology more fully, attention should be paid to the specific user context in which the technology functions. Therefore, an enriched understanding of the four types of mediation of technology is proposed by taking the lens of normative practices and analyzing the different types of mediation through this lens. The Kunduz airstrike incident, which took place in 2009 in Afghanistan, is a case in which a visual data sharing device called Rover played a prominent role. This study analyzes a complex case in society, namely, how to distinguish ride-sharing applications, such as Uber, from ordinary taxi enterprises. We conduct a structural analysis of normative practices with distinctions at the following levels: aspects; radical types, genotypes, and phenotypes; part-whole, enkaptic relationships, and interlinkages; and the distinction between qualifying and foundational functions as it is captured in the theory of normative practices. We conclude that the genotype of taxi matchmaking enterprises, of which Uber is an example, represents a (...) novel normativity that could positively serve society and also produce normative challenges, depending on its governance. Therefore, regulators should not dismiss the entire genotype of taxi matchmaking enterprises, but should address the phenotypes that are illegal or that cannot thrive without the illegal behaviors of its users. This conclusion is clear from the structural and directional sides of the practice. (shrink)

The world currently faces the highest number in recorded history of people fleeing from war and violence. Refugee-hosting countries in the western part of the world experience the effects of global issues more than ever and face dealing with humanitarian logistics for refugees on an unprecedented scale. These countries continuously optimize their policies regarding refugees by navigating between obligations toward the Geneva Refugee Treaty, manageability of the situation, and worries of their citizens voiced through public opinion. The issue can be (...) considered a wicked problem because of its unpredictability, complexity, and global scale. Presuppositions about human flourishing affect the interpretation of well-being in refugee policies. In this article, we reflect on refugees’ experiences with Dutch asylum policies, analyzing these experiences through the theoretical lenses of Abraham Maslow, Manfred Max-Neef, and Herman Dooyeweerd. We learn from Maslow the importance of providing information for the satisfaction of basic needs; from Max-Neef we learn that, with the sole exception of the need for subsistence, all fundamental needs are equally important; and from Dooyeweerd we learn that trust, though often overlooked, is important for refugee well-being. Despite societal concerns about the welfare of commercial laying hens, little attention has been paid to the welfare implications of the choices made by the genetics companies involved with their breeding. These choices regarding trait selection and other aspects of breeding significantly affect living conditions for the more than 7 billion laying hens in the world. However, these companies must consider a number of different commercial and societal interests, beyond animal welfare concerns. In this article we map some of the (...) relevant dilemmas faced by genetics companies in order to outline the scope of opportunities to improve welfare under current market conditions. This includes identifying cases where different animal welfare concerns conflict. We discuss the moral responsibility of laying hen genetics companies and the welfare implications that derive from the choices they make and the policies they follow. In addition to evaluating a selection of predominant current practices and breeding goals, we outline different angles from where to assess the moral legitimacy of various industry practices and policies. We discuss specific issues such as injurious pecking, bone health, induced moulting, chick culling and the circumstances of breeding stock. (shrink)

Participatory action research (PAR) is a form of community-driven qualitative research which aims to collaboratively take action to improve participants’ lives. This is generally achieved through cognitive, reflexive learning cycles, whereby people ultimately enhance their wellbeing. This approach builds on two assumptions: (1) participants are able to reflect on and prioritize difficulties they face; (2) collective impetus and action are progressively achieved, ultimately leading to increased wellbeing. This article complicates these assumptions by analyzing a two-year PAR project with mothers of (...) disabled children from a South African urban settlement. Participant observation notes, interviews, and a group discussion served as primary data. We found that mothers’ severe psychological stress and the strong intersectionality of their daily challenges hampered participation. Consequently, mothers considered the project ‘inactionable’. Yet, many women quickly started expressing important individual and collective wellbeing transformations. To understand these ‘unlikely’ transformations, a feminist relational account, in particular, that of relational wellbeing, proves essential. We reflect on the consequences of these findings for the dominant PAR methodology and operationalization, and propose to sensitize future PAR with marginalized women by employing relational wellbeing as an overarching ontological awareness. The inclusion of stakeholders and knowledge systems is increasingly valued in research to address complex socio-ecological challenges around the world. Often these projects take place in cross-cultural setting where external researchers risk perpetuating historically extractive research models that not only harm local communities but damage the validity of research projects. Responsible community engagement is increasingly recognized as a practice that can improve researcher-community relationships and research quality by incorporating principles of ethics, reciprocity, and power sharing. In partnership with local community (...) leaders, researchers from a U.S. university coded 76 research articles for indicators of responsible community engagement conducted in the Samburu, Kenya community since 2000. Findings from this study suggest that most of the research in Samburu has followed extractive models. Of the 76 articles reviewed many failed to acknowledge ethical protocols, did not address relevance of the study to the local community, and did not report any indication of outreach or community change as a result of the research. While a portion of articles showed evidence of community involvement in the studies, the involvement was primarily limited to secondary roles with little to no shared decision-making power over the research process. We discuss methodological considerations for future research and steps that must be taken in order to shift the norm and practice of academic research in sites such as Samburu, Kenya. (shrink)

Can concepts represent subtleties in emotions, bodily sensations, and perceptions? What is the nature of mental representations in nonlinguistic and prelinguistic creatures? _The European Review of Philosophy, Volume 6_ tackles issues such as these by asking how far the analogy between conceptual and nonconceptual content can be carried. By bringing together contributions from both conceptualists and nonconceptualists, this volume sheds new light on an issue sure to interest cognitive scientists and philosophers of mind.

In this theoretical contribution, we interpret the notion of professional development in the light of concepts coming from cognitive development. This brings us to consider teacher training as not only having to allow the elaboration of skills, but also as having to encourage the development of new cognitive structures. We explore the theoretical concepts in relation with certain processes revealed by the reflexive texts of the students. Finally, we propose ways that could foster certain dimensions of global professional development in (...) learners, among which self-regulated learning, the focus on certain concerns and taking into account certain types of information. Being able to categorize objects as similar or different is an essential skill. An important aspect of learning to categorize is learning to attend to relevant features and ignore irrelevant features of the to-be-categorized objects. Feature variability across objects of different categories is informative, because it allows inferring the rules underlying category membership. In this study, participants learned to categorize fictitious creatures. We measured attention to the aliens during learning using eye-tracking and calculated the attentional focus as the ratio of (...) attention to relevant versus irrelevant features. As expected, participants’ categorization accuracy improved with practice; however, in contrast to our expectations, their attentional focus did not improve with practice. When computing the attentional focus, attention to the aliens’ eyes was disregarded, because while eyes attract a lot of attention, they did not vary across aliens. Yet, an explorative analysis of attention to eyes suggested that participants’ attentional focus did become somewhat more efficient in that over time they learned to ignore the eyes. Results are discussed in the context of the need for instructional methods to improve attentional focus in learning to categorize. (shrink)

This article provides current Schwartz Values Survey (SVS) data from samples of business managers and professionals across 50 societies that are culturally and socioeconomically diverse. We report the society scores for SVS values dimensions for both individual- and societal-level analyses. At the individual-level, we report on the ten circumplex values sub-dimensions and two sets of values dimensions (collectivism and individualism; openness to change, conservation, self-enhancement, and self-transcendence). At the societal-level, we report on the values dimensions of embeddedness, hierarchy, mastery, affective (...) autonomy, intellectual autonomy, egalitarianism, and harmony. For each society, we report the Cronbach’s α statistics for each values dimension scale to assess their internal consistency (reliability) as well as report interrater agreement (IRA) analyses to assess the acceptability of using aggregated individual level values scores to represent country values. We also examined whether societal development level is related to systematic variation in the measurement and importance of values. Thus, the contributions of our evaluation of the SVS values dimensions are two-fold. First, we identify the SVS dimensions that have cross-culturally internally reliable structures and within-society agreement for business professionals. Second, we report the society cultural values scores developed from the twenty-first century data that can be used as macro-level predictors in multilevel and single-level international business research. This book provides an introduction to postphenomenology, an emerging school of thought in the philosophy of technology and science and technology studies, which addresses the relationships users develop with the devices they use.

Taking regular walks when living with Parkinson’s disease has beneficial effects on movement and quality of life. Yet, patients usually show reduced physical activity compared to healthy older adults. Using auditory stimulation such as music can facilitate walking but patients vary significantly in their response. An individualized approach adapting musical tempo to patients’ gait cadence, and capitalizing on these individual differences, is likely to provide a rewarding experience, increasing motivation for walk-in PD. We aim to evaluate the observance, safety, tolerance, (...) usability, and enjoyment of a new smartphone application. It was coupled with wearable sensors and delivered individualized musical stimulation for gait auto-rehabilitation at home. Forty-five patients with PD underwent a 1-month, outdoor, uncontrolled gait rehabilitation program, using the BeatWalk application. The music tempo was being aligned in real-time to patients’ gait cadence in a way that could foster an increase up to +10% of their spontaneous cadence. Open-label evaluation was based on BeatWalk use measures, questionnaires, and a six-minute walk test. Patients used the application 78.8% of the prescribed duration and enjoyed it throughout the program. The application was considered “easy to use” by 75% of the patients. Pain, fatigue, and falls did not increase. Fear of falling decreased and quality of life improved. After the program, patients improved their gait parameters in the six-minute walk test without musical stimulation. BeatWalk is an easy to use, safe, and enjoyable musical application for individualized gait rehabilitation in PD. Developing countries face numerous barriers to conducting effective and efficient ethics reviews of international collaborative research. In addition to potentially overlooking important scientific and ethical considerations, inadequate or insufficiently trained ethics committees may insist on unwarranted changes to protocols that can impair a study's scientific or ethical validity. Moreover, poorly functioning review systems can impose substantial delays on the commencement of research, which needlessly undermine the development of new interventions for urgent medical needs. In response to these concerns, the Drugs (...) for Neglected Diseases Initiative, an independent nonprofit organization founded by a coalition of public sector and international organizations, developed a mechanism to facilitate more effective and efficient host country ethics review for a study of the use of fexinidazole for the treatment of late stage African Trypanosomiasis. The project involved the implementation of a novel ‘pre-review’ process of ethical oversight, conducted by an ad hoc committee of ethics committee representatives from African and European countries, in collaboration with internationally recognized scientific experts. Background In the EU, clinical assessors, rapporteurs and the Committee for Medicinal Products for Human Use are obliged to assess the ethical aspects of a clinical development program and include major ethical flaws in the marketing authorization deliberation processes. To this date, we know very little about the manner that these regulators put this obligation into action. In this paper, we intend to look into the manner and the extent that ethical issues discovered during inspection have reached the deliberation processes. (...) Methods To gather data, we used the Dutch Medicines Evaluation Board database and first searched for the inspections, and their accompanying site inspection reports and integrated inspection reports, related to central marketing authorization applications of drugs submitted to the European Medicines Agency from 2011 to 2015. We then extracted inspection findings that were purely of ethical nature, i.e., those that did not affect the benefit/risk balance of the study. Only findings graded at least major by the inspectorate were included. Lastly, to identify how many of the ethically relevant findings reach the application deliberation processes, we extracted the relevant joint response assessment reports and reviewed the sections that discussed inspection findings. Results From 2011 to 2015, there were 390 processed applications, of which 65 had inspection reports and integrated inspection reports accessible via the database of the Dutch Medicines Evaluation Board. Of the 65, we found ERFs in 37. The majority of the ERFs were graded as major and half of the time it was informed-consent related. A third of these findings were related to research ethics committee processes and requirements. Of the 37 inspections with ERFs, 30 were endorsed in the integrated inspection reports as generally GCP compliant. Day 150 joint response assessment reports and Day 180 list of outstanding issues were reviewed for all 37 inspections, and none of the ERFs were carried over in any of the assessment reports or list of outstanding issues. Conclusion None of the ethically relevant findings, all of which were graded as major or critical in integrated inspection reports, were explicitly carried over to the joint assessment reports. This calls for more transparency in EMA application deliberations on how ERFs are considered, if at all, in the decision-making processes. (shrink)

Satzes aus den „Vingt Regards sur l'Enfant-Jésus" aufgezeigt, der dem „Blick des Geistes der Freude" gewidmet ist. Wie in Ruusbroecs „Zierde der geistlichen Hochzeit" finden sich in der Musik pneumatologische Bildmetaphern wie die des Tanzes, der Jagd, aber auch Übereinstimmung im Ausdruck der Freude und der Einigkeit des Geistes mit dem Vater und dem Sohn. Über (...) seine charakteristischen Farbklänge ist es Messiaen gelungen, sogar die ruusbroecsche Rede vom Minnebrand des Geistes in der Seele musikalisch umzusetzen und dem Geist der Weisheit und der Wahrheit musikalisch Ausdruck zu verleihen. Auf diese Weise trägt zeitgenössische Musik bei, das Geheimnis des Heiligen Geistes tiefer zu erfassen.On the occasion of the Messiaen jubilee 2008, this article shows analogue structures between the Music of the French composer Olivier Messiaen and the mysticism of the Flemish theologian Jan van Ruusbroec . My examination is based on the X. movement of Messiaen's "Vingt Regards sur l'Enfant-Jésus", which is dedicated to the "Vision of the Spirit of Joy". Like Ruusbroec's "Adornment of the Spiritual Marriage", the music of Messiaen contains pneumatological metaphors like the dance and the hunt, but is also accords with Ruusbroec's work in expressing the joy and unity of the Holy Spirit with the Father and the Son. Through his characteristic sound-colours, Messiaen even succeeds in musically expressing what Ruusbroec describes as the Spirit's "firebrand of love" within the soul and in giving the Spirit of wisdom and truth a musical form. This demonstrates how contemporaneous music can contribute to a deeper understanding of the mystery of the Holy Spirit. (shrink)

Why do agent-relative reasons have authority over us, reflective creatures? Reductive accounts base the normativity of agent-relative reasons on agent-neutral considerations like ‘having parents caring especially for their own children serves best the interests of all children’. Such accounts, however, beg the question about the source of normativity of agent-relative ways of reason-giving. In this paper, I argue for a non-reductive account of the reflective necessity of agent-relative concerns. Such an account will reveal an important structural complexity of practical reasoning (...) in general. Christine Korsgaard relates the rational binding force of practical reasons to the various identities or self-conceptions under which we value ourselves. The problem is that it is not clear why such self-conceptions would necessitate us rationally, given the fact that most of our identities are simply given. Perhaps, Harry Frankfurt is right in arguing that we are not only necessitated by reason, but also, and predominantly by what we love. I argue, however, that “the necessities of love” (in Frankfurt’s phrase) are not to be separated from, but should be seen as belonging to the necessities of reason. Our loves, concerns and related identities provide for a specific and important structure to practical reflection. They function on the background of reasoning, having a specific default role: they would lose their character as concerns, if there was a need for them to be cited on the foreground of deliberation or if there was a need to justify them. This does not mean that our deep concerns cannot be scrutinised. They can only be scrutinised in an indirect way, however, which explains their role in grounding the normativity of agent-relative reasons. It appears that this account can provide for a viable interpretation of Korsgaard’s argument about the foundational role of practical identities. (shrink)

À travers ses innombrables travaux, il n’a cessé de rappeler l’importance d’une approche critique et interdisciplinaire du droit. Tel est dès (...) lors l’esprit et le fi l conducteur des deux journées organisées en l’honneur de celui qui fut, notamment, une cheville ouvrière de la revue Déviance et Société. La peine est un thème sur lequel Michel van de KERCHOVE a écrit les plus belles pages, mobilisant tour à tour les ressources du droit pénal et de la sociologie juridique, de la théorie générale et de la philosophie du droit. L’ambition de cet ouvrage est d’être une référence sur cette question. C’était l’occasion pour les auteurs de se mettre au travail sous le regard vigilant de Michel van de KERCHOVE, ce qui est peut-être le plus bel hommage qui pouvait lui être rendu. Le sens, la fonction et les justifications de la peine Dans un premier temps, il s’est agi d’interroger le sens, la fonction et les justifications de la peine à travers la littérature, la philosophie et la politique. La peine et les peines sont, ensuite, examinées au regard de l’exigence des droits fondamentaux garantis aujourd’hui dans les instruments universels et régionaux de protection des droits de l’homme. Les auteurs se dirigent alors vers les scènes européenne et internationale où se situent déjà aujourd’hui, et certainement encore plus à l’avenir, le centre de gravité du droit pénal. Les évolutions de la peine et de son exécution Dans un second temps, les auteurs abordent les évolutions de la peine et de son exécution pour interroger l’inflation pénale, la victimisation et le contexte sécuritaire qui caractérisent le droit pénal contemporain. Enfin, en abordant certains contentieux et dispositifs périphériques à la peine, ils S’interrogent le sens et les contours que prend aujourd’hui, et peut-être demain, le droit pénal. (shrink)

The article deals with the classical idea that God's will is the foundation of moral obligation. The particular theory should be understood as a theory of a certain moral practice. Therefore, its 'Sitz im Leben' is first invoked by means of an episode of Walter Scott's The Heart of Midlothian. Then a strong version of the theory is stated and defended against a couple of current and classical objections. A successful defense would give rational support to the theory, but it (...) would not qualify the theory as the best in the field. That depends on the quality of its rivals. One of those, Christine Korsgaard's recent impressive Kantian reflective endorsement view is discussed. The conclusion is that it does not provide stronger grounds for the reality and inescapability of moral obligations than the divine command theory. (shrink)

What I set out to do is to cast some doubt on the thesis that, in Bernard Williams's words, any appeal to God in morality “either adds nothing at all, or it adds the wrong sort of thing”. A first conclusion is that a morality of real, inescapable and (sometimes) for the agent costly obligations, while being at home in a theistic metaphysic, does not sit easily with metaphysical, atheistic naturalism. The second conclusion is that Christine Korsgaard's impressive ethical (...) project which is neutral towards theism and atheism fails in giving a satisfying account of such obligations. My final claim is that a theistic account in terms of a strong divine command theory might succeed where non- and atheistic accounts seem to founder. (shrink)

Physicians frequently encounter situations in which their professional practice is intermingled with moral affordances stemming from other domains of the physician’s lifeworld, such as family and friends, or from general morality pertaining to all humans. This article offers a typology of moral conflicts ‘at the margins of professionalism’ as well as a new theoretical framework for dealing with them. We start out by arguing that established theories of professional ethics do not offer sufficient guidance in situations where professional ethics overlaps (...) with moral duties of other origins. Therefore, we introduce the moral theory developed by Christine M. Korsgaard, that centres around the concept of practical identity. We show how Korsgaard’s account offers a framework for interpreting different types of moral conflicts ‘at the margins of professionalism’ to provide either orientation for solving the conflict or an explanation for the emotional and moral burden involved in moral dilemmas. A critical discussion of Christine Swanton's target-centred account of right action.

ABSTRACT The problem of the captivated gaze has been taken up repeatedly in philosophy. Plato's Allegory of the Cave stands paradigmatically for this. Here, the gaze at the shadowy images prevents people from taking the path to the sun. Denis Diderot's critical reinterpretation of Plato's Allegory of the Cave is less well known. In Diderot, the view of the artificial light images is just as captivating as Plato's shadow images. Unlike there, however, Diderot does not distinguish between perception and cognition (...) but instead focuses on the significance of the seemingly unimportant shift of the gaze within the cave. Diderot determines the starting point of the realisation of freedom in the liberation of one's own gaze from the captivation intended by third parties. Prerequisites for the liberation of the gaze are the realisation of an interruption. It is shifts in the alignment of the eyeballs that become visible here as lucid intervals and which, in Diderot, become the starting point of power analysis and the site of revolt and freedom practice. In this article, I will show how Diderot's demand for enabling the individual realisation of lucid intervals is not first and foremost an aesthetic, but a highly political one. The criteria of art, which are defined by Diderot and have not lost their relevance until today, are based on his explosive insight that the incessant captivation of the gaze stands in the way of democratisation.
